I have been informed that the clause I cited is effectively vitiated by a consent decree resulting from a suit brought by some Illinois abortionists. - Michael Kremer

720 ILCS 510.6 contains this: \"(3) The law of this State shall not be construed to imply that any living individual organism of the species homo sapiens who has been born alive is not an individual under the \"Criminal Code of 1961,\" approved July 28, 1961, as amended.\" This seems to imply that a fetus born alive after an abortion would be subject to the same protections as any other human individual. So the courts and attorney general seem to have misread the law. - Michael Kremer

"the man hired to perform the abortion would have to declare in advance to his clients and the world that he is about to botch the job and deliver a baby, instead of 'terminating' it."

Does this accurately characterize the previous sentence? I would think "viable" simply means the child could survive if delivered rather than terminated -- not that it will in fact be delivered in a viable condition. - SDG
