The ridiculous premise at the heart of Roe—that abortion is protected by a Constitution that nowhere mentions it—has made Roe arguably the least settled law in the land. But as cases seeking to overturn it head to the Court, some ask if doing so will undermine the Court’s legitimacy. But that happened when the Court made its original decision in 1973.
